1. Introduction
These Terms and Conditions apply to your use of the HCC Distribution Pty Ltd (ABN 66 683 058 504) website at www.hccdistribution.com and to goods and services purchased from HCC Distribution Pty Ltd (HCC Distribution, we, us or our).
By using this website or placing an order with us, you agree to these Terms and Conditions.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
2. Use of Website
You may use this website for lawful purposes only.
You must not misuse the website, interfere with its operation or security, attempt to gain unauthorised access to any part of the website or use the website in a way that infringes the rights of HCC Distribution or any third party.
We may update, modify, suspend or withdraw website content, features or services at any time.
While we take reasonable care to keep information on the website accurate and current, website content is provided for general information and may be subject to change.
3. Products and Services
HCC Distribution supplies automotive and motorsport parts, components and related products, together with vehicle, engine, workshop and related services.
We take reasonable care to ensure product descriptions, specifications, images, pricing and availability shown on our website are accurate. Product images are provided for illustrative purposes and minor variations in appearance, packaging or presentation may occur.
Where dimensions, specifications, compatibility or other characteristics are important to your application, please contact us before ordering if you require confirmation.
Customers are responsible for confirming that products are suitable for their intended vehicle, application or purpose unless HCC Distribution has specifically advised otherwise.
Nothing in this section limits any rights you may have where goods do not correspond with their description or otherwise fail to meet a consumer guarantee under the Australian Consumer Law.
4. Pricing, Orders and Payments
Unless otherwise stated, prices displayed to the general public on our website are in Australian dollars and include GST where applicable.
Prices, availability and product information may change without notice. A price change will not retrospectively affect an order already accepted by HCC Distribution.
Placing an order does not necessarily constitute acceptance of that order. We reserve the right to decline or cancel an order before supply where, for example, a product is unavailable, an incorrect price or product information has been published, payment cannot be processed, or we reasonably suspect an order is fraudulent.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled goods.
Payment must be made using an accepted payment method or in accordance with approved account terms.
Unless otherwise agreed in writing, cars, engines, gearboxes, differentials and repair work must be paid for before supply or collection.
For goods supplied on an approved credit account, ownership of the goods remains with HCC Distribution until payment for those goods has been received in full, to the extent permitted by law.
5. Product Availability, Backorders and Special Orders
Product availability displayed on our website may change and is not guaranteed until an order has been accepted and processed.
Some products may need to be ordered from a manufacturer or supplier. Where an item is unavailable or subject to an extended lead time, we may contact you to discuss the expected availability, an alternative product, a backorder or cancellation of the affected item.
Estimated availability and lead times are provided in good faith but may be affected by manufacturers, suppliers, international freight, customs and other circumstances outside our reasonable control.
Products specifically sourced, manufactured, modified or ordered for a customer may be treated as special-order items. We will endeavour to identify special-order items before the order is finalised where practicable.
6. Shipping and Delivery
We deliver goods within Australia using third-party freight and delivery providers.
Shipping costs are calculated based on factors including the products ordered, weight, dimensions, destination and available freight services. Shipping costs will generally be displayed at checkout or otherwise advised before the order is completed.
Some large, heavy, unusual or specialist items may require a separate freight quotation. Where this applies, we may contact you before dispatch to confirm the available delivery options and costs.
Delivery dates and transit times are estimates only and are not guaranteed. Delivery may be affected by carrier delays, destination, weather, availability and circumstances outside our reasonable control.
Customers are responsible for providing accurate delivery details and ensuring that delivery can reasonably be made to the nominated address.
Where tracking information is available, it may be provided after dispatch.
Nothing in this section limits any rights or remedies available under applicable law.
7. Returns and Refunds
We want you to be satisfied with your purchase. If you need to return an item, please contact HCC Distribution before sending it back.
Change of Mind: Unused and unopened items may be returned within 30 days of delivery, subject to approval. Items must be in their original condition and packaging and suitable for resale. Return shipping costs are the responsibility of the customer.
Incorrect, Damaged or Faulty Items: If an item is faulty, damaged, incorrectly supplied or does not match its description, please contact us as soon as possible so we can assess the issue and arrange an appropriate remedy.
Special Order and Custom Items: Specially ordered, custom-made, modified or non-stock items cannot generally be returned for change of mind.
Installed or Used Parts: Products that have been installed, fitted, used, altered or damaged after delivery cannot generally be returned for change of mind.
Refunds: Approved refunds will be made to the original payment method, generally within 2 business days after the returned goods have been received and inspected. Processing times for the refund to appear in your account may vary depending on your payment provider. Original delivery charges are generally non-refundable for change-of-mind returns.
How to Request a Return: Contact HCC Distribution at orders@hccdistribution.com with your order or invoice number, the item you wish to return and the reason for the return before sending any goods back.
Nothing in this returns policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law. Where goods fail to meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy as provided by law.
8. Consumer Guarantees and Warranties
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where those guarantees apply.
For goods, these guarantees may include that goods are of acceptable quality, fit for any purpose made known to us, match their description and correspond with any sample or demonstration model where applicable.
If goods have a major failure, you may be entitled to reject the goods and choose a refund or replacement and may also be entitled to compensation for reasonably foreseeable loss or damage. If a failure is not major, you may be entitled to have the failure remedied within a reasonable time.
Manufacturer warranties may also apply to particular products. Any manufacturer warranty is in addition to, and does not replace or limit, rights available under the Australian Consumer Law.
Warranty claims may require reasonable information to allow us or the manufacturer to assess the claim, including proof of purchase, photographs, details of the fault and information about the installation and use of the product.
9. Product Compatibility, Installation and Motorsport Use
Many products supplied by HCC Distribution are specialised automotive or motorsport components. Correct product selection, installation, configuration, maintenance and use can be important to their safe and reliable operation.
Unless HCC Distribution has specifically confirmed suitability for a particular application, customers are responsible for confirming that products are appropriate for their vehicle, configuration and intended use.
Products should be installed, adjusted and maintained in accordance with manufacturer instructions and, where appropriate, by a suitably qualified or experienced person.
Motorsport and competition use can place significantly greater loads and stresses on vehicles and components than ordinary road use. Customers participating in motorsport are responsible for ensuring their vehicle and components are appropriate, properly installed, inspected and maintained for their intended competition or motorsport application.
Some products may be intended for competition or off-road use only. Customers are responsible for determining whether a product is lawful and appropriate for use on public roads or in a particular competition or category.
Nothing in this section excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
10. Cancellations
If you wish to cancel an order, please contact us as soon as possible.
Where an order has not yet been processed or dispatched, we will generally attempt to accommodate a cancellation request.
An order may not be able to be cancelled once goods have been dispatched or where a special-order, custom-made, modified or specifically sourced product has already been ordered or produced for you.
Where an order cannot be cancelled, our Returns and Refunds terms and any rights available under the Australian Consumer Law will continue to apply.
HCC Distribution may cancel an order where we cannot reasonably fulfil it, including because of product unavailability, supplier issues, pricing or listing errors, payment issues or other circumstances that prevent supply. Where we cancel an order for which payment has already been received, the amount paid for the cancelled goods will be refunded.
11. Workshop and Service Work
Where HCC Distribution performs repairs, servicing, fabrication, engine, vehicle or other workshop work, the scope of work and estimated pricing may be provided by quotation, estimate, work order or other communication.
An estimate is based on the information reasonably available before or during the work and may change if additional faults, damage, parts or work are identified.
Where practicable, we will seek approval before undertaking material additional work outside the agreed scope.
Completion dates for workshop and service work are estimates and may be affected by parts availability, subcontractors, additional faults identified during the work and other circumstances outside our reasonable control.
Any specific terms stated on an accepted quotation or work order form part of the agreement for that work.
12. Intellectual Property
Unless otherwise stated, content on this website, including text, graphics, branding, logos, photographs, product information and website materials, is owned by or licensed to HCC Distribution Pty Ltd.
You may view and use website content for personal or legitimate business purchasing purposes.
You must not reproduce, distribute, modify, republish or commercially exploit our website content without our prior permission, except where permitted by law.
Third-party trademarks, product names, logos and other intellectual property remain the property of their respective owners.
13. Limitation of Liability

HCC Distribution is not responsible for loss resulting from incorrect product selection, improper installation, unauthorised modification, misuse, neglect or use contrary to manufacturer instructions, except to the extent that HCC Distribution is responsible for the loss or liability cannot lawfully be excluded.

Personal information collected through our website, orders and dealings with customers will be handled in accordance with applicable privacy laws and our Privacy Policy.
Information may be provided to service providers where reasonably necessary to process payments, fulfil orders, arrange delivery, provide services or operate our business.

These Terms and Conditions are governed by the laws of Queensland, Australia.
Subject to any rights you may have under applicable law, disputes relating to these Terms and Conditions are subject to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them.
